Description:	The purpose of the State responsibility is to improve the activities that are carried out by public bodies, in defense of the rights of the governed; however, in practice, better provision of state services has not been achieved, but damages to the governed continue to be caused, including on many occasions with deliberate actions. Given this position, the present work seeks to determine whether it would be possible to incorporate a figure such as punitive damages in the activity of the State, and thus avoid future damages. La figura de la responsabilidad del Estado tiene como fin el mejoramiento de las actividades que son desarrolladas por los órganos públicos, en defensa de los derechos de los gobernados; sin embargo, en la práctica no se ha logrado una mejor prestación de los servicios estatales, sino que se siguen causando daños a los gobernados, inclusive en muchas ocasiones con actuaciones premeditadas. Ante esta postura, el presente trabajo busca determinar si sería posible incorporar una figura como la de los daños punitivos en la actividad del Estado, y de esta forma evitar daños a futuro.
