| Description: | En este trabajo se hizo una revisión de la legislación castellana y del derecho indiano y sobre cuál debía ser la función de la cárcel durante el período virreinal, en donde quedó establecido que ese edificio estaba destinado a la custodia del reo en lo que se resolvía su situación jurídica, motivo por el cual debía conservársele en óptimas condiciones para que cumpliera con el cometido. La revisión de expedientes del ramo criminal tanto del Archivo de la Real Audiencia de Guadalajara como del Archivo General de la Nación acercan al conocimiento de la distancia que existió entre lo escrito en la legislación y lo que al interior de esos recintos sucedía en la jurisdicción de la Intendencia de Guadalajara. Prisons of the Intendencia de Guadalajara: holding cells, disorder and crime during the decline of the viceroyalty (1780-1820) This work revisits stipulations in the Spanish legislation and in the Indian rights over what should be the function of the jail during the Viceregal period in which it was established that this building should be used for the custody of the offender while his legal situation was resolved – reason for which it should be kept in optimum condition. Revision of the files of the criminal branch of the Archivo de la Real Audiencia de Guadalajara and the Archivo General de la Nación clarify the understanding of the distance which existed between what was established in the legislation and what happened in the spaces under the jurisdiction of the Intendencia de Guadalajara.
