dc.descriptionThe need to construct a decisional model anchored in the standard of “reasonableness”is amply preached. What the magistrate demands in the argumentative work of thejudicial resolution is that it be expressed in clear language, that can be assimilatedby the parties in lawsuit and by the social groups in order to overcome the formalistand academic decisions. In addition, the principle of decisional reasonableness isconsistent with the legal system and judicial precedents, in the vertical (upper courts)and horizontal (courts of first instance) sense. Undoubtedly, a reasonable decisionimplies an intellectual work of the judge, where he or she bases his/her arguments, thus contributing to strengthen legal security as far as the decisions encompass ahigh degree of predictability.en-US
dc.descriptionSe pregona la necesidad de construir un modelo decisional anclado en el estándar de la “razonabilidad” a fin de evitar la “arbitrariedad”. Lo que exige al magistrado en la faena argumentativa de la resolución judicial, es que se exprese con lenguaje claro, pensando que la misma, debe ser asimilada por las partes (máxime sin son vulnerables) en pleito y por el colectivo social, intentando superar las decisiones formalistas y academicistas. Además, el principio de razonabilidad decisional, supone coherencia con el sistema jurídico y con los precedentes judiciales, en sentido vertical (tribunales superiores) y en sentido horizontal (tribunales de primera instancia). Indudablemente que una decisión razonable implica un trabajo intelectual del juez, dónde éste, estribe sus argumentos lógica y legalmente, contribuyendo de esta manera a fortalecer la seguridad jurídica en cuanto las decisiones guarden un alto grado de predictibilidad.   es-ES
